El Tribunal de Apelaciones (TA) de la FCRF decidió de forma unánime y definitiva confirmar la resolución de revocatoria de la licencia de la Asociación Deportiva Guanacasteca que tomó el Comité de Licencias el pasado 9 de abril del 2025. Por lo tanto, el recurso de apelación fue declarado sin lugar.
El TA estudió y analizó los argumentos legales del club frente al contenido de la resolución y al expediente de investigación que llevó el Comité de Licencias. Este último órgano constató y confirmó que hubo un incumplimiento grave en el criterio financiero que sustentaba la licencia de club profesional y vulneró el fair play financiero, así como la equidad deportiva.
Habiéndose resuelto la apelación, la FCRF informa los hallazgos:
- Se determinó que hubo una nueva administración No Reportada al Comité de Licencias de la FCRF.
- Hubo depósitos de sumas superiores al medio millón de dólares en la cuenta bancaria del club provenientes del extranjero de dos personas (una física y otra jurídica) y cuyo origen no fue demostrado según lo exige la normativa en la materia. Estos depósitos tampoco estaban registrados en la información financiero – contable aportada inicialmente por el Club. Los Estados de Cuenta Bancarios fueron aportados a la investigación.
- Existieron transferencias de dinero de sumas importantes de dólares de la cuenta bancaria del club en el país, a cuentas bancarias en el extranjero, sin justificación alguna en la información financiero – contable de la Asociación.
- Hubo modificación de información contable, documentos, actos y declaraciones de testigos, posterior a los cuestionamientos del Comité de Licencias y a la entrega de los Estados Financieros del Club, tendientes a reclasificar los dineros en las cuentas bancarias como “préstamos mercantiles”.
- Hubo hechos de relevancia económica y financiera que no fueron reportados conforme al Reglamento de Licencias.
- La forma y el contenido de la información financiera presentada no cumplió con la práctica contable – financiera vigente.
De este modo, adicionalmente a la revocatoria de la licencia de club profesional, el expediente se remitirá a la Comisión de Ética por conductas concretas del señor Jorge Arias Gómez y también se remitirá para lo que corresponda al Colegio de Contadores Públicos de Costa Rica respecto de los profesionales involucrados.
Cabe destacar que la revocatoria de la licencia está acompañada de una multa de 2.500.000 colones por las otras faltas cometidas.
Finalmente, se destaca el argumento del TA respecto el Principio de Estoppel que en múltiples ocasiones ha reiterado la jurisprudencia del Tribunal de Arbitraje Deportivo (TAS) respecto la aplicación y vigencia de la normativa aplicada en este caso. Este principio establece que cuando una parte ha configurado sus comportamientos a una determinada norma, no puede alegar vicio o desconocimiento de esta cuando le perjudique.
